Terms and Conditions of Sale
November 1, 2026
1. Purpose
These terms apply to every booking of a guided kayak tour on azurkay.com, between the company AzurKay ("Azurkay"), whose contact details appear in the legal notice, and you ("the customer"). They are accepted when you confirm payment.
2. The tours
Azurkay offers guided outings of about 4 hours on the Côte d'Azur, in the morning (10 a.m. to 2 p.m.) or in the afternoon (4 p.m. to 8 p.m.), with a maximum of 16 participants.
Included: the kayak, paddle, life jacket, snorkeling mask, dry bag, briefing, supervision by a qualified instructor and souvenir photos.
The itinerary may be adapted on the day, depending on the sea and the group's level. Rock jumping, offered on some tours, is always optional and supervised.
A private tour reserves the entire time slot for your group.
3. Booking
You choose a tour, a date and a time slot, then enter your details and pay online. Your places are held for about 30 minutes during payment.
The booking is final once you receive the confirmation email. Check your information: the summary and the meeting point are included in it.
4. Prices and payment
Prices are shown in euros, including all taxes, on each tour's page and at the time of booking.
Payment is made in full at the time of booking, by card, through Stripe. The invoice is available after payment.
The picnic or aperitif option (€15 per person) is paid in cash on site. It is not included in the price paid online.
Promotional codes cannot be combined, unless stated otherwise, and apply according to the conditions indicated when they were issued.
5. No right of withdrawal
Our tours are leisure activities provided on a specific date. In accordance with Article L221-28, 12° of the French Consumer Code, the 14-day right of withdrawal does not apply. The free cancellation provided for in article 6 remains available.
6. Cancellation by the customer
- Up to 24 hours before departure: free cancellation and full refund.
- Less than 24 hours before departure, no-show, or arrival after the group has left: no refund.
To cancel, write to reservation@azurkay.com stating your booking reference. The time the message is received is what counts.
The refund is made to the payment method used, within 5 business days.
7. Cancellation by Azurkay, weather and safety
The outing depends on the sea and the wind. The instructor alone decides, for everyone's safety, whether it can take place or must be modified.
If we cancel, we notify you by email and by WhatsApp. You then choose between a postponement to another available date and a full refund, made within 5 business days.
This refund covers the price of the tour. It does not cover costs you incurred elsewhere (transport, accommodation, etc.).
Outing interrupted after departure: if the outing has to be interrupted at sea because of weather or for another safety reason, you receive a partial refund, within 5 business days.
8. Participation requirements
- Swimming: each participant must be able to swim at least 25 meters. By booking, you confirm this for each participant. A minor who cannot swim may take part only with their parents' authorization, and their parents must be present on site.
- Health: each participant must be fit for 4 hours of physical activity at sea. Report any health problem to the instructor before departure. If in doubt, seek a doctor's advice.
- Age: minimum 6 years old. Any minor must be accompanied by a responsible adult, who confirms their ability.
- Instructions: the life jacket is mandatory and the instructor's instructions must be followed.
- Exclusion: the instructor may refuse a participant whose condition or behavior endangers the group or themselves (alcohol, drugs, failure to follow instructions). No refund is given in that case.
- Time: arrive 15 minutes before departure.
9. Meeting point
The meeting point is given in the confirmation email or communicated to you before the outing. You are responsible for getting to that point.
10. Equipment and personal belongings
The equipment remains the property of Azurkay. You must take care of it and you may be held liable for deliberate damage.
The dry bag protects your belongings from splashes, with no absolute guarantee. We advise you not to bring valuables. Azurkay is not responsible for their loss or damage, except through its own fault.
11. Supervision, insurance and liability
Outings are supervised by instructors holding the qualifications required by the French Sports Code. Azurkay has taken out professional civil liability insurance, the details of which are provided on request.
We advise you to check that you have personal insurance covering accidents.
Azurkay is liable for damage caused by its fault or that of its instructors, under the conditions provided by law. No clause of these terms limits its liability in the event of bodily injury, nor your statutory consumer rights.
12. Souvenir photos
The instructor may take photos during the outing and send them to you afterwards. We use them for our communications only with your consent. You may ask the instructor not to photograph you.
13. Force majeure
Neither party is liable for a failure caused by an event of force majeure within the meaning of Article 1218 of the French Civil Code. The outing concerned is then postponed or refunded, as provided in article 7.
14. Personal data
Your data is processed as set out in our legal notice and personal data.
15. Complaints and mediation
Write to us first at reservation@azurkay.com.
If the disagreement persists, you may refer the matter free of charge to a consumer mediator. Their contact details will appear here once we have joined, and are provided on request.
16. Governing law
These terms are governed by French law. In the event of a dispute, you may bring the matter before the court of your place of residence or any other court competent under the law. The French version prevails.
